IN NO EVENT WILL VITAL HEALTH BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by binding individual arbitration, rather than in court. Arbitration will be conducted under the consumer arbitration rules of JAMS or the American Arbitration Association (AAA), as you elect.

Class action waiver. Arbitration will be conducted on an individual basis. You may not bring a claim as a plaintiff or class member in any class, consolidated, or representative proceeding.

Opt-out. You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms by sending written notice to legal@vtlhlth.com. Your notice must include your name, email address, and a clear statement that you wish to opt out. Opting out does not affect any other provisions of these Terms.

Exceptions. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent imminent harm.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions.

Changes to These Terms

We may modify these Terms at any time. We will provide at least 30 days notice of material changes by email (to users who have provided an email address) and by posting notice on this Site. Your continued use of the Site after the effective date of any modified Terms constitutes your acceptance of those Terms.
